DECISION OF THE
CITY COUNCIL
ON AN APPEAL OF
THE BUILDING OFFICIAL'S DECISION
DATED NOVEMBER 11, 2005, REGARDING THE SCHOOL OF THE WOODS
On December 1, 2005, at 7:30 p.m. the City Council of the City of Hilshire Village, Texas, considered and heard the appeal, request dated November 15, 2005, by the School of the Woods ("School") of the decision of the Building Official, dated November 11, 2005.
Requirement 1
"FIRE LINE NEEDS TO BE UNCOVERED FOR INSPECTION WITH 200
LBS. OF HYDROSTATIC TEST PRESSURE FOR TWO HOURS."
Requirement 2
"DOMESTIC WATER LINE NEEDS TO BE UNCOVERED FOR INSPECTION WITH 100 LBS. OF HYDROSTATIC TEST PRESSURE FOR TWO HOURS."
Requirement 3
"SANITARY SEWER LINES NEED TO
BE UNCOVERED FOR INSPECTION WITH A WATER TEST HEAD OF 10 FEET."
Requirement 4
"FIRE LANE PAVING AREA SHALL BE CONCRETE OR ASPHALT AS PER CODE."
Interested persons present at the hearing were given the opportunity to present their positions, documents, and were heard.
All plans, permits, correspondence, and documents contained in the CityÕs files and those submitted at the hearing regarding this appeal were made a part of the record, and they are made a part of the record in this appeal by this reference.
(1) City Council voted favorably on the following matters related to the appeal:
1.1. City
Council to serve as the Appeal Board - & - Chairman retains the right to
vote: Motion by Zandra Anderson:
Second by Robin Border: Passed by affirmative 5-0 vote.
1.2. Selection
of presiding Board member ("Chairman"): John Denninger moved to select Robin Border: Second by Zandra Anderson: Passed by
affirmative 5-0 vote, selecting Robin Border as Chairman.
1.3. [Later in the Council meeting, after the hearing had been concluded] Discussion initiated by Zandra Anderson, followed by housekeeping Motion by Robin Border to confirm retention of Rufus T. Summers as the fire safety and code consultant to advise the City in the appeal, at the expense of the School of the Woods. [Note this topic had been addressed on the record by the Chairman at the beginning of the hearing]: Motion seconded by Connie Castro: Passed by affirmative vote 3-2, with Tucker, Castro, and Border for, and Anderson and Denninger voting no.
(2) After
hearing the evidence, presentation, and comments of all concerned, the City
Council voted to X GRANT in part or
to and X DENY in
part the appeal of Requirement 1
(fire [water supply] line), with the following conditions (if any, by a
vote of Five (5) ÒForÓ to -0- ÒAgainstÓ. Motion by Denninger, Second by
Anderson to deny the appeal regarding uncovering the line (i.e. the line is to
be uncovered for Village Fire Department inspection): & to grant
the appeal on the 200 lbs. test for 2 hrs, except above the Fire Department

-0- ÒAgainstÓ. Motion by Denninger to
grant, second by Anderson: that inspection was adequate, based upon the
represented inspections by the School's Engineer of record and by Inspector
Charlie Ehrlund, which provide an equivalent method of protection. Each

-0- ÒAgainstÓ. Motion to grant by
Denninger, second by Anderson, based upon the testimony that the School had
performed an air test and an in-pipe camera view, the recollection of Inspector
Charlie Ehrlund who viewed the on-site materials, which indicated the line was sufficient for acceptance, and
that this information provided an equivalent method of protection.

Motion by Tucker to grant, second by Anderson: that other paving or surfaces may be considered per the Fire Code, which must be approved pursuant to Code Appendix ¤ D102. Each member voted as follows:
