REGULAR COUNCIL MEETING FEBRUARY 20, 2001
A. CALL TO ORDER: The regular meeting of the City of Hilshire Village was called to order by Mayor Jane Fisher on February 20, 2001 at 7:30 PM at 1003 Wirt Road, Suite 103, Houston, Texas. Invocation was given by Jane fisher. Present were Mayor Pro-tem John Denninger, Councilmembers Connie Castro, Jerry Riley, Vernon Kahanek and Robin Border.
Mayor Fisher presented the previously distributed minutes of January 16, 2001 meeting and Councilmember Castro said that on page 2- the total initial cost of website should be $120.00 - not $170.00. Mayor Pro-tem Denninger moved the minutes be accepted with change, seconded by Councilmember Castro, and it passed 5-0.
B. REPORTS TO COUNCIL:
1. Police: Detective Gary Finkelman was not able to attend the meeting, but had left copies for Council and citizens. There were 67 calls, of which 12 were alarm calls, and 55 miscellaneous calls. Four traffic tickets were issued.
2. Treasurers Report : Cheryl Wolfe, Treasurer, gave the January 2001 Report. For the General Fund, revenues were $99,000, and expenses were $35,000, giving a net income of $64,000. Year to date revenues were $384,000, expenses were $137,000, giving a net income of $247,000. Assets total $1,492,000, of which $832,000 is Metro. Utility Fund Year to date income is $46,000, with expenses of $46,500, giving a net loss of $500.00.
3. Fire Commissioner: David Labbe, Alternate Fire Commissioner, distributed a written report regarding the February 19, 2001 Fire Commissioners Meeting. There were 3 issues discussed: (1)Consideration of additional consulting of Dr. Craig Wasserman, (2) Painting or replacement of ladder truck (3) Amount of training given . No action was taken.
C. ACTION ONLY: Mayor Fisher presented the Consent Agenda. She had a question about reimbursement to Mike Woodruff, and it was explained that the $15.14 was for copies of surveys for Board of Adjustment hearing. It was moved by Mayor pro-tem Denninger, seconded by Councilman Border, and it passed 5-0.
D. DISCUSSION AND ACTION ON THE FOLLOWING:
1. Order of Election/ Writ of Election:
AN ORDINANCE OF THE CITY OF HILSHIRE VILLAGE, TEXAS PROVIDING FOR THE HOLDING OF A GENERAL ELECTION TO BE HELD ON MAY 5, 2001, FOR THE PURPOSE OF ELECTING THREE COUNCILMEMBERS FOR TWO YEARS AND MAYOR FOR ONE YEAR UNEXPIRED TERM, AND PROVIDING FOR THE CANCEL OF ELECTION IF ALL CANDIDATES ARE UNOPPOSED AND THUS DECLARING CANDIDATES ON BALLOT AS DULY ELECTED; AND PROVIDING DETAILS
Mayor Fisher presented the previously distributed ordinance for approval. It was moved by Mayor Pro-tem Denninger, seconded by Councilmember Castro, and it passed 5-0. Election will be held on May 5, 2001 for Mayor for one year unexpired term and three Councilmembers.
2.Request from Rick Benson, Century Industries to Address Council regarding Garbage Rate Increase: Mr. Rick Benson of Century Industries addressed the Council and distributed a cost review and request reflecting an increase of 38%.Mr. Benson said he is now president of company; that there had been some changes, and that rate increase request was needed. After some discussion, Mr. Benson was reminded that at the January meeting, City Council approved a 4% increase as per the contract, and would take no further action at this time.
3. Acceptance of Resignation of Ken Good, Member of Board of Adjustment, and Appointment of Replacement: Mayor Fisher asked for a separate motion for acceptance of resignation of Ken Good, Alternate Board of Adjustment Member, who resigned due to moving out of the City. It was moved by Denninger, seconded by Castro, and it passed 5-0. She then presented the name of Wally Partridge (1301 Glourie Drive) to Council for approval of appointment as Alternate Board of Adjustment Member. It was moved by Councilmember Castro, seconded by Councilmember Riley that he be approved for appointment, and it passed 5-0
4. Approval of Payment for Cypress tree to be planted, with marker to read " To Village Fire Department from the Citizens of Hilshire Village": A memorandum had previously been distributed to City Council from Mayor Sue Speck regarding donation of funds for 6 trees to be planted at the Village Fire Departments dedication of their new facilities. This memo was sent to all the Village mayors. Mayor Pro-tem Denninger said that new facilities were being paid out of the Fire Department budget that was apportioned to all the Villages, and he believed that landscaping ( a tree) should not be an additional item. Councilmember Castro desired to know exact location where trees from the Villages would be planted. It was moved by Councilman Border, seconded by Councilmember Riley that $185.00 be given to Hedwig Village for the cypress tree planting. Councilmembers voted as follows: Border and Riley approved; Councilmembers Castro, Kahanek and Denninger opposed. Motion opposed 3-2.
5. Recreational Vehicle Ordinance Amendment to Zoning Ordinance
AN ORDINANCE OF HILSHIRE VILLAGE, TEXAS AMENDING THE CODE OF ORDINANCES BY ADDING TO CHAPTER 12, ZONING REGULATIONS, A NEW SECTION 40.04 TO BE INCLUDED WITHIN THE "REGULATIONS APPLICABLE TO ALL DISTRICTS"; PROVIDING REGULATIONS FOR GOVERNING THE LOCATION OF PARKED OR STORED RECREATIONAL VEHICLES OR TRAILERS, BOATS, AND UTILITY TRAILERS, WHICH MUST BE SCREENED FROM PUBLIC VIEW FROM ANY PUBLIC STREET WHEN PARKED OR STORED; PROVIDING THAT NO RECREATIONAL VEHICLE OR TRAILER, VEHICLE, BOAT OR UTILITY TRAILER SHALL EVER BE USED IN THE CITY FOR LIVING QUARTERS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY.
Mayor Fisher reminded Council that the proposed ordinance draft had been distributed to Council sometime ago and wanted to know if Council had any more changes before it was advertised for public hearing. The Mayor had contacted Jack Murphy, Building Official, to determine if he had any changes that he thought should be made and Mr. Murphy said perhaps Board of Adjustment might input some ideas.To date, Board of Adjustment had not submitted any changes. She requested Council to agree upon a date for the public hearing that must be held prior to any change in the Zoning Ordinance. It was moved by Councilmember Riley, seconded by Councilman Border that a public hearing for this amendment to Zoning ordinance be held at 6:30 PM on March 20, 2001, prior to the regular Council meeting. Motion carried 5-0.
6. Study for Acquisition of Property-- Westview and Pech Road/ Others : Mayor Fisher said that from time to time that there had been some talk about City buying some property for City offices. Mayor Fisher said it was observed that property at Westview and Pech (usually known as JRs) was for sale. Councilmember Riley and Mayor Fisher had looked at the building. A real estate packet had been distributed to Council previously. Other alternatives are available. There is a vacant lot for sale in a commercial area in Hilshire Village, and other commercial owners might be contacted to ascertain if they would be interested in selling. After some discussion, it was decided the Mayor would appoint a committee to study costs involved, and how financing could be arranged.
E. DISCUSSION
1. Annexation of a parcel referred to as "J.R.s" : Councilmembers had previously been given a letter from Mario DellOsso dated January 31, 2001. Previously, it was thought that the parcel was in Harris County, and not in any city. The City Attorney provided information that as a General Law City, JRs could not be annexed unless owner requested to the City. Further, Houston had extraterritorial jurisdiction authority to annex this by law. Also, according to real estate packet regarding JRs, property owners were paying taxes to Houston. Therefore, annexation cannot be done.

G. MAYOR AND COUNCIL COMMENTS: `Mayor Fisher asked Councilmember Castro if she had received many "Citizen Survey" letters. Councilmember had received 18 letters as of 2/15/01, and made up a colored graph that she distributed to Council to show results. She has received some more surveys since then and in March will update graph. Major concerns were water pressure, lighting and garbage. Councilmember Castro also showed Council her business cards that had approved business card setup logo. Mayor Fisher also wanted item in Civic newsletter asking citizens not to throw grease down the sewer drain. The sewer had to be cleaned out on Burkhart due to grease stoppage.
F: CITIZENS COMMENTS: David Labbe (1311 Pine Chase Drive) said he had been concerned about temporary storage of boats, etc. in the changes in Zoning Ordinance but his questions had been answered.
Vicki Tucker (1214 Glourie) would like to see a ban on "manufactured homes anywhere". She also wanted to know if there had been a time limit set for Monarch Schools "temporary buildings" removal.
Mayor will review documents and advise her.
H. ADJOURNMENT: It was moved by Mayor Pro-tem Denninger, seconded by Councilmember Riley that meeting be adjourned. Meeting adjourned at 8:55PM.
