JULY 24, 2001 COUNCIL MEETING (in lieu of July 17th Regular Council Meeting)

Following the Budget Workshop

 

A. CALL TO ORDER: The meeting of the City of Hilshire Village was called to order by Mayor Ershel Redd on July 24, 2001 at 8:01 PM ( following the Budget Workshop) at 1003 Wirt Road, Suite 103, Houston, Texas. Invocation was given by Mayor Redd. Present were Councilmembers Connie Castro, Vicki Tucker, Vernon Kahanek and Robin Border. Mayor Pro-tem John Denninger was absent.

Mayor Redd presented the previously distributed minutes of the regular meeting of June 19, 2001. Councilman Border said that on page 2, Section 3, TRNCC abbreviation should be changed to "TNRCC". Councilmember Castro moved the minutes be approved with change, seconded by Border, and it was approved unanimously.

B. REPORTS TO COUNCIL

1. Police: Detective Gary Finkelman distributed the June 2001 Report to Council and citizens. There were 53 service calls. Alarm calls totaled 26, and there was one traffic citation. There were two warrant arrests. There was a burglary of a motor vehicle, from the Holy Cross Lutheran Church. Car was later recovered in the Houston Heights.

2. Treasurer’s Report : Mitzy Shaw, Treasurer, was absent. However, financial statements for the month of June, 2001 had been previously distributed and will be filed.

3. Fire Commissioner: Tom Archer, Fire Commissioner, was absent.

C. ACTION ONLY

1. Consent Agenda: Mayor Redd presented the Consent Agenda for approval. It was moved by Councilman Border, seconded by Councilmember Tucker they be approved, and it passed 4-0.

D. DISCUSSION AND ACTION ON THE FOLLOWING:

1. A Proclamation of the City of Hilshire Village, Texas for the 18th Annual National Night Out Program to be held on Tuesday, August 7, 2001 at 6:30 PM. Mayor Redd presented the proclamation for approval, and read it for benefit of the citizens attending. It was moved by Councilmember Castro, seconded by Councilman Border that it be approved, and it passed unanimously.

2. RESOLUTION 01-7-24- GRATITUDE AND APPRECIATION TO VICKIE TUCKER AND HILSHIRE VILLAGE VOLUNTEERS FOR THEIR PARTICIPATION IN 2001 VILLAGE INDEPENDENCE FESTIVAL AND WINNING FIRST PRIZE FOR FLOAT IN JULY 4TH PARADE: Mayor Redd presented the previously distributed resolution and read it for the benefit of the citizens attending. Councilmember Castro said that the names of Jerry Riley and Bob Sommer should be included in the resolution as they had been serving as representatives of Hilshire Village for several years and attended all the preparatory organizational meetings. She moved that resolution be approved with addition, and it was seconded by Councilman Border, and it passed unanimously. Mayor Redd instructed the City Secretary to send all people listed a copy of the Resolution.

 

 

3.A JOINT RESOLUTION OF THE COMMISSIONERS COURT OF HARRIS COUNTY, TEXAS AND THE CITY COUNCIL OF THE CITY OF HILSHIRE VILLAGE, TEXAS PROVIDING FOR THE ADOPTION OF AN INTERJURISDICTIONAL EMERGENCY MANAGEMENT PLAN. (Resolution 01-7-24 B) Chief Calagna had spoken at the previous Village Mayors Luncheon about the Villages participating in an interjurisdictional emergency management plan. Mayor Redd presented this resolution for action, and it was moved by Councilman Border that it be approved, seconded by Councilmember Tucker, and it passed unanimously.

4. Authorization for Bidding Process for Storm Drainage Improvements at 1200 block West side of Ridgeley R.O.W. Several citizens had expressed concern about the storm drainage to Council in the form of telephone calls and letters, and Jack Murphy, Engineer for the City, had sometime ago prepared an overall drainage plan that would include the "problem areas". Bids were solicited 3 years ago on one small portion as at the time, the City had not entered into a new Metro contract, but did not get anyone to bid. After some discussion, it was decided that the City would authorize a comprehensive up-to-date drainage study so that contractors were more likely to bid on a larger amount of work. Councilman Border moved that the authorization listed above be amended to include a comprehensive drainage study for the City, and the motion was seconded by Councilmember Tucker, and the amended authorization was approved unanimously.

 

5. Approval of New Garbage Company Contract: On May 23, 2001 bids were received from four companies. The refuse bid comparison was prepared and distributed at the June meeting, but was tabled until this time due to some questions Council had. There was discussion as to some of conflicting statements. Councilmember Castro made a conditional motion that Aggressive Haulers, Inc., the low bidder, be awarded the contract provided that proper legal language, approved by the City Attorney , be in the formal contract. Contract would be for $13.00 per household, with backdoor pickup, to include grass clippings, and recycling. This contract would commence September 1, 2001, as present garbage company’s contract expires August 30th. There would have to be a section added in reference to termination of services if necessary with a reasonable amount of notice provided by both parties. Sample contract provided by Aggressive Haulers, Inc. would be completed and submitted to Aggressive and the City Attorney so that it could reviewed for proper wording before Mayor signed. This motion was seconded by Councilman Border, and it passed 4-0.

6. Approval of 2000 International Residential Code:

AN ORDINANCE AMENDING CHAPTER 3 OF THE CODE OF ORDINANCES OF THE CITY OF HILSHIRE VILLAGE, TEXAS, BY ADDING ARTICLE 3.1100, ADOPTING THE "INTERNATIONAL RESIDENTIAL CODE," 2000 EDITION, AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, INC.; REGULATING THE CONSTRUCTION, ALTERATION, ENLARGEMENT, AND REPAIR OF RESIDENTIAL BUILDINGS AND STRUCTURES; PROVIDING CERTAIN AMENDMENTS AND DELETIONS TO SAID INTERNATIONAL RESIDENTIAL CODE; ESTABLISHING FEES FOR THE ISSUANCE OF PERMITS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH VIOLATION OF ANY PROVISION HEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY.

 

This ordinance was unintentionally excluded when previous International Building Codes were approved by Council, and that error is being corrected now. The previous adoption included non-residential only, so this Code has to be adopted for residential construction. Councilman Border moved that this International Building Code for Residential Structures be adopted. Councilmember Castro seconded, and it passed unanimously.

E. DISCUSSION

1. Tree Ordinance Review: Councilmember Tucker had requested a review of the present tree ordinance to prevent so many trees being cut down and not replaced with new construction. She gave as an example a house on Glourie Street where trees were cut down before the house was demolished and no tree compliance had been filed because no building permit application had been submitted. The objection to so many trees being taken out without replacement is that Hilshire Village would lose its "urban forest" image. Mayor Redd appointed Vicki Tucker as chairman of that committee to review other Villages’ tree ordinances and make recommended changes.

F. CITIZENS COMMENTS : Bob Sommer (1114 Guinea Drive) wished to express his appreciation to Mayor and Council for all the time devoted to preparing the budget, and for the timely decisions that had been made by this Council.

G.. MAYOR AND COUNCIL COMMENTS: Councilmember Castro informed Council that she was pleased to announce that the real-estate swap between Wal-Mart and the church was signed June 20, 2001. She wanted to thank Council for agreeing to hire Mr. Jim Blackburn. attorney with Blackburn and Carter, to protest to Wal--Mart, because with his action and the active participation by the Hilshire Village Wal-Mart committee directors, she felt it aided the real estate transaction. The Hilshire Village Wal-Mart committee directors were Jay Fort, Hedy Treloar, Jim Zimmermann, Wally Partridge,and Connie Castro.

Councilmember Castro provided a written summary to Council of the I-10 ad hoc Committee meeting of June 29, 2001, which has been posted on City Bulletin Board. Gary Trietsch, Tx Dot Project Engineer, related that November 2001 the ROW purchases will begin. Thirty-seven hardship purchases have already been made out of 400 needed. The project is divided into eleven sections. Detail plans are 12-20% complete. When 35% complete, meetings will begin with each affected City, covering sound walls, ponds, etc.

Mayor Redd had spoken with Mario Dell’Osso, the City Attorney, in reference to Im’s Service Center, and Mr. Dell’Osso recommended that pictures be taken of the property in question for future reference.

H. ADJOURNMENT: It was moved by Councilmember Castro, seconded by Councilman Border that meeting be adjourned. Meeting adjourned 9:30 PM.
